Conservatory Order (Minimum Tax) Petition No. E005 of 2021 ruling.
We would like to provide a quick update on court’s issuance of interim injunction orders on implementation of minimum tax by the Commissioner. In view of the above, please note that in the event that KRA wins the petition, they would demand principal taxes, penalties and interest.
Further, it is our considered view that if you are in a tax loss position, you may hold on and await the final ruling/directions. However, if you are in a tax payable position and that minimum tax is higher than installment tax, we recommend you pay instalment tax to avoid penalties of non-payment.
